Terms of use

These terms explain what you can expect from Export and what we ask from you when you use it.

40bytes
The short version

Use Export only with accounts and content you are authorized to access. Follow the law and Meta’s rules, protect your account, and use exported information responsibly.

These Terms of Use (“Terms”) are an agreement between you and 40bytes (“40bytes,” “we,” “us,” or “our”). They apply when you visit export.40bytes.com or access the Export product and related services.

01

Your agreement

By using Export, you agree to these Terms and our Privacy Policy. If you use Export for a company or another organization, you confirm that you are authorized to accept these Terms for that organization.

You must be at least 18 years old and legally able to enter into a binding agreement. If you do not agree to these Terms, do not use Export.

02

Accounts and access

You are responsible for keeping your Export account and connected accounts secure. Tell us promptly if you believe someone has accessed your account without permission.

When connecting Facebook or Instagram, you confirm that:

  • You are authorized to manage the Facebook Pages or Instagram professional accounts you select.
  • You may lawfully access and export the selected comments and related information.
  • The information you provide to Export is accurate and current.

Access to Meta products is also governed by Meta’s terms, policies, permissions, and technical limits. Meta may change or remove access independently of 40bytes.

03

Acceptable use

Please use Export responsibly. You may not:

  • Access accounts, posts, comments, or personal information without authorization.
  • Use exported information for harassment, discrimination, unlawful surveillance, spam, or other harmful activity.
  • Violate privacy, intellectual-property, consumer-protection, or other applicable laws.
  • Sell personal information or build advertising profiles from exported data without a valid legal basis and all required notices and permissions.
  • Bypass usage limits, interfere with security, probe for vulnerabilities, or disrupt the service.
  • Reverse engineer Export except where applicable law expressly permits it.
  • Use automated methods to overload the service or avoid restrictions imposed by Export or Meta.
  • Misrepresent your identity, authorization, or relationship with 40bytes.

We may investigate suspected misuse and restrict access when reasonably necessary to protect users, third parties, or the service.

04

Content and exports

You keep any rights you have in the information you submit or retrieve through Export. You give us a limited permission to process that information only as needed to operate, secure, and support the service as described in our Privacy Policy.

You are responsible for:

  • Deciding whether you have a lawful reason to collect, download, store, share, or otherwise use an export.
  • Providing required notices and honoring privacy or deletion requests relating to files in your possession.
  • Securing downloaded files and limiting access to appropriate people.
  • Reviewing exports for accuracy before relying on them.

Export does not transfer ownership of comments or grant rights beyond those you already have. A successful export does not by itself mean every later use of that information is lawful.

05

The service

We may improve, change, add, or remove features as the product develops. We aim to provide a reliable service, but we do not promise that Export will always be available, uninterrupted, or compatible with every post, account, browser, or Meta API change.

Export and its original software, design, branding, and documentation belong to 40bytes or its licensors. These Terms give you a limited, non-exclusive, non-transferable right to use the service while you comply with them. They do not transfer our intellectual-property rights to you.

Feedback is welcome. If you send ideas or suggestions, you allow us to use them without restriction or payment, but you are not required to provide feedback.

06

Payment

Some features may require payment in the future. Before charging you, we will clearly show the price, billing period, included usage, renewal terms, and how to cancel. You authorize applicable charges only when you choose a paid plan.

Taxes may be added where required. Except where law requires otherwise or the purchase terms say differently, charges for a completed billing period are non-refundable.

07

Termination

You may stop using Export and disconnect Meta access at any time. You can request account and connected-data deletion by following the instructions in our Privacy Policy.

We may suspend or terminate access if you materially violate these Terms, create security or legal risk, fail to pay applicable fees, or use the service in a way that could harm others. When practical, we will provide notice and an opportunity to resolve the issue.

Provisions that logically need to continue—including ownership, disclaimers, liability limits, and responsibility for downloaded files—survive termination.

08

Disclaimers

To the fullest extent permitted by law, Export is provided “as is” and “as available.” We disclaim implied warranties of merchantability, fitness for a particular purpose, non-infringement, and any warranties arising from a course of dealing.

We do not control Meta, Facebook, Instagram, their APIs, or content supplied through them. We are not responsible for platform outages, API changes, missing or inaccurate source information, revoked permissions, or actions taken by third-party platforms.

Nothing in these Terms limits rights or warranties that cannot legally be excluded.

09

Limits on liability

To the fullest extent permitted by law, 40bytes and its team will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenue, business opportunities, goodwill, or data arising from Export.

Our total liability for claims relating to Export will not exceed the greater of:

  • The amount you paid us for Export during the 12 months before the event giving rise to the claim; or
  • US $100.

These limits apply regardless of the legal theory and even if we were advised that a loss was possible. They do not apply where prohibited by law.

If your unlawful use of Export, your content, or your violation of these Terms causes a third-party claim against 40bytes, you agree to be responsible for resulting reasonable losses and costs to the extent permitted by law.

10

General terms

Washington law governs these Terms, without regard to conflict-of-law rules. Any dispute that is not eligible for small-claims court will be handled by the state or federal courts located in Spokane County, Washington, and both sides consent to those courts’ jurisdiction.

If one part of these Terms is unenforceable, the remaining parts stay in effect. Our failure to enforce a provision is not a waiver. You may not transfer these Terms without our consent; we may transfer them as part of a reorganization, financing, merger, acquisition, or sale of the service.

These Terms and the Privacy Policy are the entire agreement between you and 40bytes regarding Export unless we enter into a separate written agreement with you.

We may update these Terms as the service or law changes. We will post the revised version and update the effective date. For material changes, we will provide additional notice when appropriate. Continuing to use Export after revised Terms take effect means you accept them.
